Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Client"), and Pratik Chauhan ("Developer", "I", "me", or "my"), concerning your access to and use of the pratikchauhan.com website as well as any related services, applications, or freelance work provided by me.

2. Intellectual Property Rights

Unless otherwise agreed upon in a separate written contract:

• Final Deliverables: Upon full payment of all invoices, the Client will own the final website design, source code, and associated deliverables created for their specific project.
• Portfolio Rights: I retain the right to showcase the completed work in my digital portfolio, case studies, and social media for promotional purposes, unless a Non-Disclosure Agreement (NDA) is explicitly signed.
• Pre-existing Code: Any pre-existing proprietary code, libraries, or frameworks used in the project remain the property of their respective owners (e.g., open-source licenses).

3. Services, Revisions & Payments

When engaging in a web development or consulting project:

• Scope of Work: The exact scope of work, timeline, and deliverables will be outlined in a separate project proposal or contract.
• Revisions: Projects typically include a set number of revision rounds. Additional features or scope creep outside the initial agreement will be billed at an agreed-upon hourly rate.
• Payment Terms: A non-refundable deposit is usually required before work commences. The final balance is due prior to the handover of the final source code or live deployment of the website.

4. Limitation of Liability

In no event will I be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the website or my development services, even if I have been advised of the possibility of such damages. All code is provided "as is" upon final delivery and sign-off.

5. Website Maintenance & Support

Once a project is completed and handed over, I am not responsible for future updates, plugin breakages, hosting downtime, or security breaches unless a separate, ongoing Website Maintenance Contract has been signed.

6. Governing Law

These Terms shall be governed by and defined following the laws of India. Pratik Chauhan and yourself irrevocably consent that the courts of Gujarat, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
